Creator terms

Draft, not in force. The final text is being reviewed by our lawyer.

Draft, not in force. Version 0.1, 29 October 2026.

Plain-language summary

  • You are an independent creator. You are not our employee. You choose your prices, your packages, your hours and which bookings you accept. You can work on other platforms too.
  • Tourists book you on Byeselfie and pay a 20% booking fee to us online. You get the other 80% of your price directly from the tourist, in person: half before the shoot, half after. No invoices from us, no waiting for payouts.
  • Before you go live we check your ID and your portfolio, and you accept our code of conduct.
  • You handle your own taxes, permits and insurance.
  • Be on time and keep your bookings. No-shows and late cancellations lower your ranking and can lead to removal. We always tell you why and you can ask us to look again.
  • The photos and videos are the tourist's. They are taken on the tourist's phone, or on your device if you both agree in the offer. Then you send the tourist all files on the spot, and you keep no copies.

1. Who we are and what these Terms cover

1.1 Byeselfie is operated by [COMPANY LEGAL NAME], registered in the Republic of Armenia under number [REGISTRATION NUMBER], [ADDRESS], [creators@byeselfie.com] ("Byeselfie", "we", "us").

1.2 These Terms apply when you register and offer your services on byeselfie.com and the Byeselfie app (the "Platform") as a photographer, videographer or reel maker ("Creator", "you"). The Community Guidelines, the Filming Rules and the Privacy Policy are part of these Terms.

2. Your independent status

2.1 You are an independent service provider. Nothing in these Terms makes you an employee, worker, agent, partner or representative of Byeselfie. You may not sign agreements or make promises in Byeselfie's name.

2.2 You decide freely:

  • (a) whether to offer your services on the Platform, and when you are available;
  • (b) your prices and packages;
  • (c) whether to accept or decline any booking request, without any penalty for declining;
  • (d) how you do the Shoot, within the law, the Filming Rules and the Community Guidelines;
  • (e) whether to work for other clients and other platforms at the same time. There is no exclusivity.

2.3 Byeselfie does not give you work instructions, does not set working hours and does not supervise how you perform a Shoot. Our rules on reliability (section 8) exist so that tourists can trust bookings made on the Platform.

2.4 You provide the Shoot to the tourist in your own name and under your own responsibility. Your agreement for the Shoot is made directly between you and the tourist. Byeselfie is not a party to it.

3. Who can join

3.1 To join you must:

  • (a) be at least 18 years old;
  • (b) live in, and offer Shoots in, a city where Byeselfie operates (the list of cities is on byeselfie.com);
  • (c) have the legal right to provide services in that country;
  • (d) speak English well enough to talk with tourists;
  • (e) have a real portfolio of your own work.

3.2 When you register you must tell us whether you offer your services as a business (a trader) or as a private individual. We show this on your profile because EU consumer law requires it. Tell us at once if it changes.

4. Verification

4.1 Before your profile goes live we check:

  • (a) your identity, with a valid ID document [and a selfie check, through our verification provider NAME];
  • (b) that your portfolio is your own real work; and
  • (c) that you have accepted the Code of Conduct.

4.2 We may ask for information again later, for example if your details change or if we receive a report. We may decline a profile that does not pass verification. We will tell you why.

4.3 If the law requires us to collect tax or identity details from Creators (for example under EU tax reporting rules), you agree to give us correct details when asked. We will tell you why we need them and how we use them.

5. Your profile and packages

5.1 Your profile must be true and up to date: your real name or the business name you use, the city, languages, packages, what each package includes, how long it takes, and your price.

5.2 Your price is the total price the tourist pays for the package. The booking fee is 20% of that price. The tourist pays the booking fee to Byeselfie online when booking, and pays you the remaining 80% in person. Example: if your package costs EUR 100, the tourist pays EUR 20 to Byeselfie and EUR 80 to you.

5.3 All portfolio photos and videos must be your own work, and you must have the right to show them. If a person can be recognised, you must have their permission to use the image for promotion.

5.4 We may help you with your profile and suggest changes. You decide what to publish. We may refuse or remove content that breaks these Terms or the law, and we will tell you why.

6. Bookings and payment

6.1 When a tourist books one of your packages and pays the booking fee, you receive the booking in the app. [If instant booking is off: you accept or decline within [24] hours.]

6.2 The tourist pays you directly, in person, by the method you both agreed (for example cash, Revolut or PayPal): half before the Shoot starts and half after it ends.

6.3 You and the tourist each confirm every payment in the app, right after it happens. Confirm only payments you really received.

6.4 Byeselfie does not receive, keep or pay out your money and does not charge you any fee. Byeselfie does not issue invoices to you or for you. If you must give the tourist a receipt or invoice under your local law, that is your responsibility.

6.5 Tips and extra services agreed in person are between you and the tourist.

6.6 You must not ask a tourist who found you on the Platform to cancel and re-book you outside the Platform in order to avoid the booking fee. This rule applies to that booking and to the next [12] months of bookings with that same tourist. It does not stop you from working with your own clients whom you did not meet through Byeselfie.

7. Taxes, permits and insurance

7.1 You are responsible for your own taxes and social security contributions on the money you earn, for registering a business if your local law requires it, and for any receipts or invoices to the tourist.

7.2 Byeselfie does not pay you, so it does not withhold any tax for you. We may give you general information about your tax duties, but this is not tax advice.

7.3 You are responsible for any permits you need to shoot in a place (for example city permits for commercial filming, or permission from the owner of private places), and for following the rules at landmarks. See the Filming Rules.

7.4 We recommend that you have liability insurance for your work and equipment.

8. Reliability, warnings and removal

8.1 Cancelling. If you cannot do a Shoot, cancel in the app as early as you can. A cancellation [48 hours or less] before the Shoot start is a "late cancellation". When you cancel, the tourist gets a full refund of the booking fee.

8.2 No-show. If you do not come to a Shoot, or the Shoot has not started in the app (start code entered) within [30] minutes after the start time and the tourist did not agree to a delay, it counts as a no-show.

8.3 Consequences. Late cancellations and no-shows lower your position in search results. We send you a warning after each one. Your profile is removed from the Platform if, within any 90-day period, you have:

  • (a) 2 no-shows; or
  • (b) 3 late cancellations.

8.4 Bad weather. If you and the tourist agree to cancel or move a Shoot because of bad weather, it does not count against you.

8.5 Tourist no-show. If the tourist does not come, wait at least 20 minutes at the meeting point and mark the no-show in the app. The app records your location as proof. A proven tourist no-show does not count against you.

8.6 Real emergencies (for example illness or accident) can be excused if you tell us quickly. We may ask for simple proof.

9. How ranking works

9.1 Your position in search results depends mainly on: how well your profile matches the tourist's search (city, date, type of Shoot, language, price); your rating and number of reviews; your reliability (late cancellations, no-shows, response time); how complete your profile is; and whether you have the "Founding creator" badge.

9.2 Founding creators. Creators who join in the launch phase [and are approved before DATE] get a "Founding creator" badge and higher placement for 3 months after their profile goes live.

9.3 You cannot pay for a better position. [If paid placement is ever offered, we will update these Terms first.]

10. Reviews

Tourists can review you after a completed booking. You may reply once to each review, politely. You must not write reviews of yourself or of other Creators, offer anything in return for good reviews, or pressure tourists to change a review. You can report a review that breaks the Community Guidelines.

11. The tourist's content

11.1 Shoots are recorded on the tourist's own phone by default. If you and the tourist agree in the offer, you may shoot on your own device. In that case you must send the tourist all photos and videos on the spot, before the Shoot is marked complete (for example by AirDrop, Quick Share or WeTransfer), and then delete them from your device and any cloud backup. The tourist keeps the photos and videos.

11.2 To the extent the law allows, you transfer to the tourist all economic rights in the photos and videos you take during a Shoot, for all uses, worldwide, for the full legal term, with no extra payment beyond your price. Where a transfer is not possible under your local law, you give the tourist an exclusive, free, worldwide and permanent licence to use, copy, edit and share them, including on social media.

11.3 You must not keep, copy or send yourself copies of the tourist's content, including after a Shoot on your own device. You may use a photo or video from a Shoot in your portfolio only if the tourist agrees in writing (a message in the app is enough).

11.4 Byeselfie never receives or stores Shoot content.

12. Code of conduct (summary)

You must: be on time, be polite and respectful, respect the tourist's privacy and boundaries, never touch a tourist without clear permission, never film anyone in a way they do not want, follow the Filming Rules and local law, never ask for personal favours or contact details for reasons unrelated to the booking, never pressure a tourist about payment, and never come to a Shoot under the influence of alcohol or drugs. The full Code of Conduct is in the Community Guidelines.

13. Tourist personal data

You receive some personal data about tourists (such as name, meeting point and messages) to do the booking. Use it only for that booking, keep it safe, do not share it, and delete it when you no longer need it. You are responsible for your own use of this data under data protection law.

14. Our decisions about your account

14.1 If we restrict, suspend or remove your profile, or remove content, we tell you the specific reasons, the facts behind the decision and the rule involved, at the latest when the decision takes effect.

14.2 If we end our agreement with you for reasons other than a serious breach, illegal content, safety risk or a legal duty, we give you at least 30 days' notice.

14.3 You can ask us to review any decision within 6 months by writing to [creators@byeselfie.com]. A person will look at your request and reply within [14] days.

15. Our responsibility

15.1 We provide the Platform with reasonable care and skill. We do not promise any number of bookings or any level of income.

15.2 We are not responsible for what tourists do, for in-person payments, or for loss or damage to your equipment, unless we caused it.

15.3 Our total liability to you over any 12 months is limited to [EUR 500], except where the law does not allow a limit, including for death or personal injury caused by our negligence, fraud, intent or gross negligence.

15.4 You are responsible for damage you cause to tourists or others during a Shoot, and you agree to cover Byeselfie's reasonable costs if a third party makes a claim against Byeselfie because of your breach of these Terms or the law.

16. Ending the agreement

16.1 You may close your account at any time. Please keep or cancel your upcoming bookings correctly before you do.

16.2 We may end the agreement as described in sections 8 and 14.

17. Changes to these Terms

We tell you about changes at least 15 days before they take effect (longer if the change requires you to make big adjustments). If you do not agree, you can close your account before that date.

18. Law, courts and mediation

18.1 These Terms are governed by the law of the Republic of Armenia. [Courts of Yerevan have jurisdiction, without affecting any mandatory rights you have under the law of the country where you live and work.]

18.2 [Mediators under P2B Regulation Art. 12, if Byeselfie names them: NAME 1, NAME 2.]
