1.1 Byeselfie ("Byeselfie", "we", "us") is operated by [COMPANY LEGAL NAME], a company registered in the Republic of Armenia under number [REGISTRATION NUMBER], with its registered office at [ADDRESS], email [support@byeselfie.com]. [EU representative under GDPR Art. 27 and DSA Art. 13, if appointed: NAME, ADDRESS.]
1.2 These Terms apply when you use byeselfie.com and the Byeselfie app (the "Platform") as a tourist or other customer ("you"). The Booking and Payment Terms, the Privacy Policy, the Community Guidelines and the Filming Rules are part of these Terms.
2.1 The Platform lets you find, compare and book independent local creators ("Creators") who shoot photos and videos on your own phone during your trip (a "Shoot").
2.2 Byeselfie provides the Platform and the booking service only. We do not provide the Shoot. The Creator provides the Shoot in their own name and under their own responsibility.
2.3 Creators are independent. They are not our employees, agents or representatives. They decide whether to accept a booking, set their own prices and packages, and decide how to do their work, within our Community Guidelines and Filming Rules.
2.4 Each Creator profile shows whether the Creator has told us they act as a trader (a professional) or as a private individual. If a Creator acts as a private individual, EU consumer protection law may not apply to your agreement with that Creator. Your agreement with Byeselfie for the booking service is always covered by consumer law.
3.1 You must be at least 18 years old to create an account and book. Children may appear in a Shoot only with their parent or guardian present and agreeing.
3.2 Give true and current information and keep your login safe. You are responsible for activity on your account unless it happened without your fault.
3.3 You may close your account at any time in the app settings or by email. Bookings that are already paid follow the Booking and Payment Terms.
4.1 A Creator profile shows the packages, the Creator's price, the booking fee, any taxes, and the total. The total price is shown before you confirm.
4.2 When you confirm a booking and the booking fee is paid, two agreements are made:
4.3 The booking fee, the card authorisation, cancellations, refunds, no-shows and payment issues are explained in the Booking and Payment Terms.
5.1 You pay the Creator directly, in person, by the method you both agreed (for example cash, Revolut or PayPal): half before the Shoot starts and half after it ends.
5.2 You and the Creator each confirm every payment in the app. Please confirm only payments you really made or received.
5.3 Byeselfie does not receive, hold or pass on payments to Creators. Tips, extras and changes of price are between you and the Creator.
6.1 The Shoot is recorded on your own phone. If you agree in the offer, the Creator may shoot on their own device instead. They must then send you all files on the spot, before the Shoot is completed, and keep no copies. Byeselfie never receives, stores or uses your Shoot content. Before you confirm completion, check that you received all files.
6.2 Creators agree in their terms that the Shoot content is for you to keep and use for your own purposes, including posting it on your social media. Some laws give the person who takes a photo a right to be named as its author. If a Creator asks to be credited, it is polite to do so but you are not required to unless your agreement with the Creator says so.
6.3 You are responsible for how you use your content, including getting permission from other people who can be clearly recognised in it when the law requires it.
7.1 You agree to follow the Community Guidelines and the Filming Rules, and not to:
7.2 If you break these rules we may warn you, limit your account, or close it. We will tell you why, unless the law does not allow it, and you can ask us to review the decision (see section 11).
8.1 After a Shoot you can leave a review. Only tourists who had a completed booking on the Platform can review that Creator. [Describe the check: a review is unlocked after both payment confirmations or after the Shoot time has passed.]
8.2 Reviews must be honest and about your own experience. We do not pay for reviews and we do not edit their meaning. We may remove reviews that break the Community Guidelines or the law, and we will say so.
8.3 Reviews are shown [newest first]. A Creator's rating is the average of all published reviews [from the last 12 months].
Search results are ranked using these main factors: how well the Creator matches your search (city, date, type of Shoot, language, price); rating and number of reviews; how reliable the Creator is (cancellations, no-shows, response time); how complete the profile is; and whether the Creator has a "Founding creator" badge, which gives higher placement for the first 3 months after the Creator joins. [No Creator can pay for a better position. If paid placement is added later, it will be clearly labelled.]
10.1 We are responsible for providing the Platform and the booking service with reasonable care and skill, and for the information that we ourselves publish.
10.2 Because we do not provide the Shoot, we are not responsible for:
10.3 We work to keep the Platform available, but it may sometimes be unavailable for maintenance or reasons outside our control.
10.4 Our total liability to you for a booking is limited to [the booking fee you paid for that booking / EUR 100, whichever is higher].
10.5 Nothing in these Terms limits or excludes our liability:
11.1 Problems with a Shoot. First try to sort it out with the Creator. If you cannot, report it in the app within [7] days. For payment issues, see the Booking and Payment Terms.
11.2 Reporting illegal content. Anyone can report content on the Platform that they think is illegal, using the "Report" button or [abuse@byeselfie.com]. Tell us where the content is, why you think it is illegal, and your name and email (not needed for reports about child sexual abuse material). We confirm receipt, decide carefully and without delay, and tell you what we decided.
11.3 Our decisions. If we remove your content or limit your account, we tell you the reasons and how to ask for a review. You can ask us to review the decision within 6 months. A person, not only an automated system, will look at it.
11.4 Complaints and out-of-court settlement. Write to [support@byeselfie.com]. We reply within [14] days. If you live in the EU you may also use an out-of-court dispute settlement body certified under the Digital Services Act, or a consumer dispute body in your country. [List body if Byeselfie commits to one.]
We may change these Terms for good reasons, such as a change in the law or in our service. We will tell you at least [30] days before an important change takes effect. If you do not agree, you can close your account before that date. Changes never apply to bookings already made.
13.1 These Terms are governed by the law of the Republic of Armenia.
13.2 If you are a consumer living in the EU or another country, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country. Choosing Armenian law does not take these rights away.
